Petition for Nontributary Determination for Denver-Julesburg Basin

Encana Oil & Gas (USA), Inc. has filed a petition requesting a nontributary determination for produced ground water withdrawn from non-coalbed methane oil and gas production wells constructed in, or to be constructed in, Subject Formations in eastern Boulder County and western Weld County southeast of Longmont within a defined portion of the Denver-Julesburg Geologic Basin pursuant to Rules and Regulations for the Determination of the Nontributary Nature of Ground Water Produced through Wells in Conjunction with the Mining of Minerals (“Produced Nontributary Ground Water Rules”), 2 CCR 402-17.   The formations that are the subject of the petition are the Sussex and Shannon Members of the Pierre Shale Formation.
